Section 271.5 Offence of Domestic Trafficking in Persons.


A Person Commits an Offence of Domestic Trafficking in Persons if:

They Organise

Or Facilitate

The Transportation

or Proposed Transportation

of Another Person

From One Place in Australia

To Another Place in Australia; &

They Use Coercion, Threat, or Deception,

Which Results in Them Obtaining the Victim's

Compliance to that

Transportation

or Proposed Transportation.

Section 271.5 2(b) Domestic Trafficking in Persons.


A Person Commits an Offence of Domestic Trafficking in Persons if:

They Organise or Facilitate

The Transportation

or Proposed Transportation

of Another Person

From One Place in Australia to

Another place in Australia; &

In Doing so

They are Reckless

As to Whether the Victim Will be Exploited,

Either by Themselves or Another,

After That Transportation

Or Proposed Transportation.

Penalty: Imprisonment for 12 years.

Section 271.6 Aggravated Domestic Trafficking in Persons.


A Person Commits an Aggravated Offence of

Domestic Trafficking in Persons if:

They Commit the Above Offence:

Intending

That The Victim Will be

Exploited,

Either by Themselves

Or By Another Person After Arrival,

& Either:

Subjects the Victim to

Cruel, Inhumane or Degrading Treatment;

Or

Engages in Conduct that Gives Rise to

A Danger of Death or Serious Harm

To the Victim or Another Person; &

Is Reckless as to that Danger.

Penalty: Imprisonment for 20 years.
